1. Acceptance of Terms

By accessing and using GemAce ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, please do not use the App.

These terms apply to all users of the App, including without limitation users who are browsers, players, customers, and/or contributors of content.

2. Eligibility

GemAce is intended for users who are 18 years of age or older. By using the App, you represent and warrant that:

• You are at least 18 years old
• You have the legal capacity to enter into these terms
• You will comply with all applicable laws and regulations
• You will use the App in accordance with these terms

3. License Grant

Subject to your compliance with these Terms of Service, we grant you a limited, non-exclusive, non-transferable, and revocable license to:

• Download and install the App on your compatible mobile device
• Use the App for personal, non-commercial entertainment purposes
• Access and use the features and services provided within the App

3.1 License Restrictions

You may not:

• Reverse engineer, decompile, or disassemble the App

4. Game Rules and Conduct

While using GemAce, you agree to:

• Not use any cheats, exploits, automation software, bots, hacks, mods, or unauthorized third-party software
• Not attempt to gain unauthorized access to any part of the App or its related systems
• Not interfere with or disrupt the App's services or servers
• Respect other players and maintain appropriate behavior

5. Virtual Currency and In-App Purchases

GemAce may offer virtual currency, items, or other digital content for purchase with real money. Please note:

5.1 Virtual Currency

• Virtual coins and items have no real-world value
• Virtual currency cannot be exchanged for real money
• Virtual items are non-transferable between users
• We reserve the right to modify virtual currency values or availability

5.2 Purchases

• All purchases are final and non-refundable unless required by law
• Prices may vary by location and are subject to change
• Payment processing is handled by your platform provider (Apple App Store, Google Play, etc.)
• You are responsible for all charges incurred on your account

6. Intellectual Property Rights

The App and all of its original content, features, and functionality are and will remain the exclusive property of GemAce and its licensors. The App is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6.1 User Content

If you provide any feedback, suggestions, or ideas about the App, you grant us a worldwide, royalty-free, irrevocable license to use, modify, and incorporate such feedback into the App without compensation to you.

7. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information in connection with the App is described in our Privacy Policy, which is incorporated into these terms by reference. By using the App, you consent to the collection and use of your information as outlined in the Privacy Policy.

8. Disclaimers and Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted or error-free
• All defects will be corrected
• The App is free of viruses or harmful components
• The results of using the App will meet your requirements

9. Limitation of Liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App
• Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms of Service.

Upon termination, your right to use the App will cease immediately, and you must delete all copies of the App from your devices.

10.1 Effect of Termination

Upon termination:

• All licenses granted to you will immediately cease
• You will lose access to any virtual currency or items
• Any outstanding obligations will survive termination

11. Updates and Modifications

We reserve the right to modify the App and these Terms of Service at any time. We will notify you of material changes through the App or other appropriate means. Your continued use of the App after such changes constitutes acceptance of the new terms.

11.1 App Updates

We may release updates to improve the App's functionality, security, or performance. Some updates may be required for continued access to the App.

12. Third-Party Services

The App may contain links to third-party websites or services that are not owned or controlled by us. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services.

These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of the App and supersede all prior and contemporaneous written or oral agreements.

16. Force Majeure

We shall not be liable for any failure or delay in performance under these terms which is due to fire, flood, earthquake, elements of nature, acts of God, acts of war, terrorism, riots, civil disorders, rebellions, or other similar causes beyond our reasonable control.
